Schindler strives to be accountable for all personal information under its control. Numerous individuals within Schindler are responsible for the day-to-day collection and processing of personal information including our sales associates and account and administrative personnel. Schindler has designated a Privacy Officer who is accountable for the handling of all personal information under Schindler’s control and for ensuring that the principles set out in this Policy are complied with.


2. What are the purpose and the scope of this Privacy Notice

This Privacy Notice applies to personal information Schindler collects in the course of operating our business in the United States, including online through the Sites. The Sites are intended for use of persons residing in the United States and for delivery of products and services within the United States. This Policy does not apply to any information that is exempted from the definition of "personal information" in applicable privacy legislation.

This Privacy Notice describes the types of personal information Schindler collects, the methods of collection and the purposes for which Schindler may use, share or disclose such information. 3. What information do we collect about you?

Either before or when we collect personal information from you, we will explain how we intend to use and disclose it. We will limit the collection of personal information to that which is necessary to accomplish the identified purposes and will use and disclose it only for those purposes. As you are probably aware, in the course of our relationship with you, we may collect information from a variety of sources. Most of our information comes directly from you. We collect personal information about you when you register with us (i.e. by registration form, signing up for a newsletter) or when you voluntarily complete, for example, customer surveys, provide feedback, participate in competitions or apply for job vacancies by posting your curriculum vitae (CV) on our on-line recruitment Sites. In the course of our normal business activities, we may disclose collected information to both affiliates and non-affiliated entities, as we deem necessary. 11. Do Not Track

"Do Not Track" is a privacy preference that you can set in your Internet search browser that sends a signal to a website that you do not want the website operator to track certain browsing information about you. However, because our Sites are not configured to detect Do Not Track signals from a user’s computer, we are unable to respond to Do Not Track requests.


12. Security measures to protect your Personal Information

No system for safeguarding personal or other information is 100% secure. However, Schindler uses appropriate security measures in order to reasonably protect your personal information against unauthorized access or alteration, accidental or intentional manipulation, loss and destruction. For example, our employees are trained to understand the importance of confidentiality and are required to adhere to our privacy policies and procedures. Employees who violate these policies and procedures are subject to disciplinary action.

We employ numerous practices to protect against the disclosure of information for purposes unrelated to the performance of our business functions or to individuals other than those who must use it in the course of their work activities. These practices include the use of password protection of computer files, e-mail and voice-mail, video surveillance, and other physical, electronic, and procedural safeguards.


13. Access to and Accuracy of Personal Information

You may request access to your personal information in our custody or control, and an account of our use and disclosure of that information, by contacting our Privacy Officer in writing (contact information below). In order to verify that the information is being released to the proper individual, you may be asked to provide suitable identification or to otherwise identify yourself. We will advise you in advance if a minimal charge will apply, and we will respond to your request within 30 days.

If we are unable to provide you with a list of organizations to which we have actually disclosed your personal information, we will provide you with a list of organizations to which we may have disclosed your personal information. In certain circumstances, access to personal information may be denied. If we deny your request for access to your personal information, we will advise you in writing of the reason for the refusal, unless we are prohibited by law from doing so.

You are entitled to challenge the accuracy and completeness of your personal information and have it amended as appropriate. In most cases, Schindler relies on you to provide any updates to or correction of your personal information. Where personal information is used on an on-going basis, Schindler undertakes to correct any information that is shown to be inaccurate, incomplete, or not up-to-date. Otherwise, we do not routinely update personal information unless it is necessary to fulfill the purposes for which the information is collected.

14. California Residents

"Shine the Light Law"

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of the Company to third parties for the third parties’ direct marketing purposes. Requests may be made one time per calendar year. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2023 will receive information regarding 2022 sharing activities). You may submit your request using the contact information at the end of this Policy. We do not disclose your personal information to third parties for their direct marketing purposes.

California Consumer Privacy Act ("CCPA’")

The following California Privacy Notice Addendum ("CCPA Section") applies solely to individuals who are residents of the State of California ("consumers" or "you"). This CCPA Section describes our policies and practices regarding the collection, use, disclosure, and retention of Personal Information we collect about you, including Personal Information we obtain when you access or use the Sites, or through other channels including but not limited to phone and email conversations, social media interactions on our websites and other third party websites such as social media sites, viewing our emails, attending an event, or through our authorized services providers.

This CCPA Section supplements and amends the information contained in the Sites Privacy Notice with respect to California residents. Any terms defined within the CCPA have the same meaning when utilized within this CCPA Section. The other provisions of the Sites Privacy Notice continue to apply, except as modified in this CCPA Section.

Please read this CCPA Section carefully before using the Sites or otherwise submitting information to us. By visiting the Sites or otherwise submitting information, you indicate your understanding that the collection, use, and disclosure of your information is subject to the terms of this CCPA Section and our Terms and Conditions.

IF YOU DO NOT CONSENT TO THE COLLECTION, USE, SHARING AND RETENTION OF YOUR INFORMATION AS DESCRIBED IN THIS CCPA SECTION, PLEASE DO NOT PROVIDE US WITH SUCH INFORMATION.

Personal Information We Collect

The Personal Information we collect or have collected in the preceding twelve (12) months may include the following categories. We may add to the categories of Personal Information we collect and the purpose for which we use it. In that case, we will inform you by posting an updated version of this CCPA Section on the Sites.

Identifiers – such as real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, or other similar identifiers.

Other elements – such as name, signature, characteristics or description, address, telephone number, education, bank account number, credit card number.

Characteristics of protected classifications under California or federal law – such as age.

Commercial information – such as products and services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Education information – such as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, Sec. 1232g; 34 C.F.R. Part 99).

Internet or other electronic network activity – such as browsing history, search history, a consumer’s interaction with an internet website, application, or advertisement.

Geolocation data – such as location information while using one of our Sites.

Audio, electronic, visual, or similar information – such as identifiable information obtained about you from voicemail messages, while speaking with our service representatives, including on the telephone, and captured by video cameras.

Professional or employment-related information – such as information on job applications, information needed during onboarding for payroll and benefits, and information needed for evaluating performance.

Consumer profile – such as inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, and behaviors.

Sensitive Information

Sensitive information includes:

  • Account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;
  • Citizenship or immigration status; and
  • Contents of mail, email, and text messages unless we are the intended recipient of the communication.

Personal Information does not include publicly available information from government records; deidentified or aggregated consumer information; or information excluded from the CCPA’s scope, such as certain health or medical information and other categories of information protected by different laws.

If you choose not to provide Personal Information requested by us, you may not be able to gain access to or use certain parts, services, or functions of the Sites, including receiving a response to your query.

Inferences drawn from Personal Information – e.g., individual profiles, preferences, characteristics, behaviors or other similar identifiers. The information in this category may include the following elements of Sensitive Personal Information.

We also reserve the right to disclose current or past personal information collected from you: (a) if such information is subpoenaed; (b) to comply with federal, state, or local laws; (c) to comply with a civil, criminal, or regulatory inquiry, investigation, or summons by federal, state, or local authorities; (d) to cooperate with law enforcement agencies concerning conduct or activity that we reasonably and in good faith believe may violate federal, state, or local laws; (e) to conduct an investigation, exercise or defend a legal claim, (f) if we are sold, merge with a third-party or are acquired by a third-party (collectively, "M&A Transactions") (including where we share your personal information in connection with the due diligence process associated with a potential M&A Transaction); (g) if we are the subject of bankruptcy proceedings; and/or (h) when we deem it necessary or appropriate. Users should also be aware that courts of equity, such as U.S. Bankruptcy Courts, might have the authority under certain circumstances to permit personal information to be shared or transferred to third parties without permission.

* Sell means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s Personal Information by the business to a third party for monetary or other valuable consideration, subject to certain exceptions.

** Share means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s Personal Information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged.

We do not have actual knowledge that we have Sold or Shared the Personal Information of minors under the age of 17.

We do not use or disclose your sensitive Personal Information for purposes that, with limited exceptions, are not necessary in order to provide our products and services as are reasonably expected by an average consumer requesting those goods and services.

Consumer Rights

California residents have the following rights with respect to the Personal Information we collect about them subject to certain limitations.

Right to Know About Personal Information Collected or Disclosed

We describe in this Policy our current practices as they relate to how we collect, use and disclose Personal Information. As a California resident, you have the right to request that we disclose additional information as it relates to our data collection activities during the preceding 12 months. To the extent applicable, you have the right to know:

  • The categories of Personal Information we have collected about you;
  • The categories of sources from which we collected the Personal Information;
  • The business or commercial purpose for collecting, selling, or sharing Personal Information, if applicable;
  • The categories of Personal Information we sold or disclosed for a business purpose;
  • The categories of third parties to whom we sold or disclosed Personal Information; and
  • The specific pieces of Personal Information we have collected about you.

Upon receipt of a verifiable consumer request and as required by the CCPA, we will provide a response to your requests. Any disclosures we provide will only cover the 12-month period preceding the receipt of your verifiable consumer request. With respect to Personal Information collected on and after January 1, 2022, and to the extent expressly required by applicable regulation, you may request that such disclosures cover a period beyond the 12 months referenced above, provided doing so would not require a disproportionate effort by us.

Right to Delete

You have the right to request that we delete Personal Information we collected or maintain about you, subject to certain exceptions. Upon receipt of a verifiable request, we will delete and direct any service providers, contractors and third parties to whom we disclosed your Personal Information, to delete your Personal Information.

We are not required to comply with deletion requests if we, or our service providers, contractors, or third parties, need the subject information in order to:

  • Complete the transaction for which the PI was collected, provide a good or service requested by you, or reasonably anticipated by you within the context of our ongoing business relationship with you, or otherwise perform a contract between the Company and you.
  • Help to ensure security and integrity to the extent the use of the consumer's PI is reasonably necessary and proportionate for those purposes.
  • Debug to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
  • Engage in public or peer-reviewed scientific, historical, or statistical research that confirms or adheres to all other applicable ethics and privacy laws, when the Company's deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if you have provided informed consent.
  • Comply with a legal obligation.
  • Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Right to Request Correction

You have the right, subject to certain limitations, to request that we correct any inaccurate Personal Information we maintain about you. Upon receipt of a verifiable consumer request, and as required by the CCPA, we will take appropriate steps to respond to your request.

Right to Opt Out of Having Your Information Sold or Shared

You have the right, subject to certain limitations, to opt-out of having your Personal Information sold or shared. You may exercise this right by managing your privacy preferences here.

This Site recognizes and processes opt-out preference signals by detecting and honoring choices made by the Site visitors via a pop-up Cookie Manager, where legally required. When such signals are received, we treat them as a valid request to opt-out of the sale or sharing of personal information for that browser or device, and any associated consumer profile, in accordance with applicable privacy laws. We will not charge you a fee or require any valuable consideration if you use the opt-out signal, nor will we change your experience with our website or the products and services we offer.

We will not discriminate against you for exercising any of your rights under the CCPA. This includes but is not limited to: (A) denying you goods or services; (B) charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; (C) providing you with a different level or quality of goods or services; or (D) suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services. Employees, applicants, and independent contractors have the right not to be retaliated against for exercising any of their rights under the CCPA.

Submitting Consumer Rights Requests

How to Submit

Verifiable Requests
We reserve the right to only respond to verifiable consumer requests to Know, Delete, or Correct. A verifiable consumer request is one made by any individual who is:

  • The consumer who is the subject of the request;
  • A consumer on behalf of the consumer’s minor child; or
  • The authorized agent of the consumer.

To verify your identity, we may ask you to verify Personal Information we already have on file for you. If we cannot verify your identity from the information we have on file, we may request additional information which we will only use to verify your identity, and for security or fraud-prevention purposes. Making a verifiable consumer request does not require you to create an account with us. Additionally, you will need to describe your request with sufficient detail to allow us to review, understand, assess, and respond.

Authorized Agents
You may authorize a natural person or a business (the Agent) to submit a Request to Know, Correct, Delete, Opt Out of the Sale/Sharing of Personal Information, or Limit Use of Sensitive Personal Information on your behalf. The Agent must provide signed permission to submit the request, and you must either (i) verify your own identity with the business or (ii) directly confirm with us that you provide permission to the Agent. These steps are not required when you have provided the authorized agent with power of attorney pursuant to Probate Code sections 4000 to 4465. We reserve the right to deny requests from persons or businesses claiming to be authorized agents that do not submit sufficient proof of their authorization.

Our Response
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

We reserve the right to charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded. If we determine that a request warrants a fee, we will attempt to notify you as to why we made that decision and provide a cost estimate before completing your request. We will endeavor to respond to a verifiable consumer request within forty-five (45) calendar days of receipt, but we may require an extension of up to forty-five (45) additional calendar days to respond and we will notify you of the need for the extension.

This Privacy Notice is governed by the internal substantive laws of New Jersey, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Notice shall lie exclusively with the state and federal courts within New Jersey. If any provision of this Privacy Notice is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Privacy Notice, which shall remain in full force and effect.

UNDER NO CIRCUMSTANCES SHALL SCHINDLER HAVE ANY LIABILITY WHATSOEVER FOR ANY ERRORS OR OMISSIONS IN INFORMATION ON THE SITE, OR FOR ANY DAMAGES, LOSSES, OR EXPENSES THAT MAY OCCUR WHILE ACCESSING THE SITE, OR ANY LINKED SITE, OR THE INABILITY TO ACCESS THESE SITES; OR ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE; OR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES ARISING OUT OF THE BREACH OF THIS PRIVACY NOTICE, HOWEVER OCCASIONED.
